Short- and Mid-Term Occupancy Agreement Date: 09/20/2026 Property Address: Property , Unit This agreement is classified as an Innkeeper Agreement and not a residential lease. It is intended to govern a short-term, revocable occupancy license for transient use only. It does not create a landlord-tenant relationship under California law or any other jurisdiction. The parties agree that the guest does not acquire tenancy rights. The guest affirms that they are using the unit for temporary, non-residential purposes only and will not attempt to claim tenant protections under any rent control or housing regulations. 1. Term of Stay From - , Unit will be temporarily licensed for use by from Heidi Hough (Authorized Representative). Any extension of the stay must be approved in writing (text/email), with clearly stated start and end dates with a 30-day notice. All terms of this Agreement will remain in effect during any approved extension period. Mid-month extensions will be prorated. After that, Monthly Fees are due on the 1st. Check-In: Any time after 3:00 PM Check-Out: By 10:00 AM 2. Payment The guest will pay a Hold Fee of $- to secure the reservation. This Hold Fee compensates the Owner for potential loss of lodging income or additional costs in the event of cancellation, cleaning, or damages. The Monthly Fee is due in full on the first day of check-in. If a mutual agreement is made to extend the stay, any prorated monthly fee for the extension period will be due on the date the extension begins. Thereafter, Monthly Fee will continue to be fully due by the end of the day on the 1st of each month. The Monthly Fee is $-. If the stay begins or ends on any day other than the 1st, the Monthly Fee will be prorated based on a nightly rate. The nightly rate is calculated as: Monthly Fee / Number of nights in that calendar month x Number of nights stayed. A late fee of $50 per day will be charged for any Monthly Fee not received by the due date. Payment method: Zelle to: heidifurnishedhome@gmail.com (please do not use Heidi's 424-537-7233 number). The guest is responsible for confirming that their bank can process the full Monthly Fee in one transfer. If the guest chooses to depart earlier than the agreed end date of the stay, they remain responsible for fees through the originally agreed-upon end date. No refunds or credits will be issued for early departure, unless otherwise approved in writing by the Owner or Authorized Representative. 3. Utilities and Laundry Utilities are included (heat, Wi-Fi, and electricity). Electricity is covered up to $50/month per unit. Excess usage will be billed to the guest. The on-site washer and dryer may be used as a courtesy, not as a guaranteed amenity. Reasonable and responsible use is expected. If machines are misused, the Owner may revoke access and/or impose a usage fee. Any damage to the machines caused by misuse or negligence will result in full replacement or repair costs being charged to the guest. 4. No Smoking Policy No smoking of any kind is permitted anywhere on or near the property. This includes the unit interior, shared spaces, and adjacent outdoor areas. 5. Respecting the Community Noise and activity must not disturb neighbors or other guests. Quiet hours are from 10:00 PM to 8:00 AM daily. The guest agrees not to engage in illegal or unsafe behavior on the property. The Owner or Authorized Representative may determine, using reasonable discretion, whether any activity violates this section. Repeated or serious violations may result in immediate termination of the guest's stay. 6. Use of Premises The guest agrees to use the premises lawfully and responsibly. No illegal activity is permitted. Occupancy is limited to individual(s) unless otherwise agreed in writing. Guests are responsible for the behavior of all visitors or invitees. 7. Nature of Occupancy This is a short-term, transient occupancy license, not a lease or rental agreement. This Agreement does not create a landlord-tenant relationship under any local, state, or federal laws, including but not limited to rent control or eviction protections. By signing this Agreement, the Guest affirms that: - They maintain a primary residence elsewhere (address provided below). - Their stay is for transient, temporary purposes only. - They have no intent to establish residency or claim tenant protections. The Owner grants the Guest a revocable license to occupy the premises for the term stated. The Owner or Authorized Representative may enter the premises at reasonable times for inspection, maintenance, or other needs. This license may be revoked immediately upon violation of any terms of this Agreement, at the Owner's sole discretion. 8. Holdover / Move-Out The Guest must vacate by the agreed move-out date unless an extension is approved in writing. Any unauthorized stay beyond that date is a holdover and may result in: - Legal action - Recovery of lodging fees - Court costs and attorney's fees - Deduction from the Hold Fee or additional damage charges Refusal to vacate may also be treated as trespassing under applicable law. 9. Indemnification Guest agrees to indemnify and hold harmless the Owner from any claims, damages, or liabilities arising from their use of the premises, including claims from guests or invitees. Guests' personal belongings are not covered under the Owner's insurance. Guests are advised to obtain their own travel insurance. 10. Condition and Cleaning During Stay The guest agrees to keep the premises clean and sanitary throughout the stay. This includes: - Regular trash removal - Maintaining cleanliness of surfaces, floors and appliances - Preventing mold or mildew in the bathroom by cleaning and airing out regularly If the premises are not maintained to reasonable standards, Owner may arrange for professional cleaning at the Guest's expense. 11. Condition and Cleaning at Move-Out At the end of the stay, Guest shall return the Premises, keys, and any property belonging to the Owner in clean condition, substantially the same as when received. A cleaning fee will be charged to cover routine cleaning after move-out: - $135 for studio w/kitchenette - $185 for studio w/full kitchen Guests will be liable for reasonable additional cleaning charges, including but not limited to cleaning furniture, walls, or other areas soiled beyond normal wear and tear (i.e., soiling that occurs due to negligence, carelessness, accident, or abuse). The Owner reserves the right to hire a recurring professional cleaning/maid service if the Guest fails to maintain the Premises in a clean and sanitary condition during the stay, at the Owner's sole discretion. 12. Pets Pets must be approved in advance. If approved: - The Guest is fully liable for any damage or cleaning costs caused by the pet. - Pets must be kept under control and not disturb neighbors. - Pets must be leashed while outside of the unit. - The Guest must clean up after their pet at all times and dispose of waste properly. 13. Refund of Fees / Final Terms The Hold Fee is refundable only if: - The Guest leaves the premises undamaged - Proper notice was given - All rent and utility charges are paid in full This fee may not be used as a substitute for any rent payment during the stay.
